DMCA Policy – ImpactX

At ImpactX, we respect the intellectual property rights of action video game developers, publishers, designers, writers, musicians, and all other contributors to the creation of action-oriented digital entertainment. Action video games often combine complex programming, immersive graphics, cinematic sequences, original soundtracks, and interactive gameplay mechanics, making them highly valuable creative works.

This DMCA Policy explains how copyright owners can report unauthorized use of their works, how we respond to such reports, and how users can submit counter-notifications if they believe their content was removed in error. Our goal is to protect the rights of creators while maintaining a lawful and engaging environment for players.

1. Scope of Policy

Copyrighted material in action video games includes, but is not limited to:

2. Filing a DMCA Takedown Notice

  • A statement under penalty of perjury asserting that the removal was a mistake or misidentification
  • A statement that you consent to the jurisdiction of the appropriate court and agree to accept service of process from the person who submitted the original notice
  • Your physical or electronic signature

After receiving a valid counter-notification, we will forward it to the original complainant. Unless legal proceedings are initiated within the required timeframe, the material may be restored.

4. Repeat Infringers

Users who repeatedly violate this DMCA Policy may face suspension or permanent termination of their accounts. Repeat infringement may also result in restrictions on access to certain features, gameplay modes, or community resources.

5. Fair Use

Some uses of copyrighted materials in action video games may qualify as fair use, including:

  • Reviews, critiques, and analysis
  • Educational demonstrations or tutorials
  • Streaming or recording gameplay with added commentary
  • Transformative works that significantly alter or expand upon the original content

6. Misuse of DMCA

7. Enforcement

We enforce this policy promptly to maintain a lawful and safe environment. Enforcement may include:

  • Removal of infringing material
  • Temporary suspension of accounts
  • Permanent termination for repeat offenders
  • Cooperation with copyright owners or legal authorities as required
